Somerset's Conservation Commission approved a construction management plan and grading modification for the Brighton Point LLC redevelopment of the former Brayton Point coal plant, over one commissioner's repeated no vote. Both measures passed 3-1 on roll-call votes, with the dissenting member citing a zoning violation over dust particulate limits. The panel tabled a third motion authorizing use of loam stockpiles, after commissioners said roughly 12.5 acres of soil may have been moved from a capped former coal pile without board permission.
Resident Nicole McDonald told the board "nobody deserves to breathe in the contaminated material" and argued for a zero-dust standard, citing a Massachusetts Land Court ruling. Attorney Elizabeth Schlager, representing the applicant, said the company had met "all of the requirements" set by the commission's consultant, Rue Associates.
